These terms and conditions (the "Terms and Conditions") govern the use of www.stsbo.co (the "Site"). This Site is owned and operated by ProfitAbility Studio Ltd. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property
All content published and made available on our Site is the property of ProfitAbility Studio Ltd. and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

Violate the intellectual property rights of the Site owners or any third party to the Site; or

Not use the Bookkeeping Basics Program in your educational institution without registering by email first. Email: [email protected].

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

Accounts
When you create an account on our Site, you agree to the following:

You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Goods And Services
These Terms and Conditions govern the sale of goods and services available on our Site.

The Profit Fix 12 week program and Unsexy ProfitMakers Membership are only available by application, to ensure registrants are qualified. Invoices will be emailed upon successful registration.

The following services are available on our Site:

Small Town Small Business Owners 1:1 Virtual Sessions (Paid), and

Small Town Small Business Owners Live & Virtual Custom Workshops (Paid).

The virtual sessions will be paid for in full when they are ordered. Workshop payment terms depend on the workshop being ordered and will be discussed with you in full before the order is finalized.

Additional products and services are available by invitation only and are not listed for sale on our website.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Subscriptions
Your Small Town Small Business Owners Membership subscription automatically renews monthly and you will be automatically billed until we receive notification that you want to cancel the subscription.

Your Unsexy ProfitMakers Membership subscription automatically renews monthly or annually depending on the payment option you chose when signing up for your membership. You will be automatically billed on your renewal date until we receive notification that you want to cancel the subscription.

To cancel either subscription, please email: [email protected]. Memberships can be cancelled anytime and your access to member only resources will be removed on your renewal date. For example, if your membership renews monthly on the 5th of each month and you cancel on the 20th. Your access to member only resources will be removed on the 5th of the following month.

Payments
We accept the following payment methods on our Site:

Credit Card; and

PayPal

When you provide us with your payment information, you authorize our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorize us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Workshops and 1:1 in person meetings will be invoiced and can be paid by e-transfer (Canada), wire transfer (International), cheque or bank draft, and much be paid in full a minimum of thirty days before the event or meeting starts.

Refunds
Refunds for Goods
If you purchase a mini-course, you are covered by a 30 day money back guarantee. Just send an email to [email protected] within 30 days of purchase for a full refund.

For the Done-With-You Bookkeeping Basics program, which starts on the first Monday of every other month (Jan/Mar/May/July/Sept/Nov), you are eligible for a full refund until the end of the first week (11:59pm on the Sunday that immediately follows the start of the program). After the first week, payments are non-refundable.

The Small Town Small Business Owners Membership is non-refundable, but you can cancel your membership at anytime and the membership will expire at the next renewal date.

Refunds for Services
We provide refunds for services sold on our Site as follows:

1:1 Services

Payment for a 1:1 virtual session is required at time of purchase. Your payment will be fully refunded if the session is cancelled at least 24 hours before it is scheduled to start. There are no refunds for cancellations that happen less than 24 hours before the session is scheduled to start.

For 1:1 in person meetings, full payment is required 30 days before the meeting. Your payment is fully refundable if you cancel 30 days or more before the scheduled meeting. If you cancel less than 30 days but more than two weeks before the meeting, there will be a 25% cancellation fee. If you cancel less than two weeks but more than 5 days before the meeting, there will be a 50% cancellation fee. There are no refunds for cancellations made less than 5 days before the meeting.

Services provided to organizations

Virtual workshops require a 25% non-refundable deposit when they are scheduled. The balance is due a minimum of 5 days before the workshop is scheduled to take place. Virtual workshops are booked directly with us, and we will provide more information about payments and refunds during those discussions.

In-person workshops require a 50% non-refundable deposit when they are scheduled. The remaining balance is payable when we arrive for the workshop. In-person workshops are booked directly with us and we will provide more information about payments and refunds during those discussions.

Consumer Protection Law
Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability
ProfitAbility Studio Ltd. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless ProfitAbility Studio Ltd. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of the Province of Manitoba.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
